Marriage Registration under Special Marriage Act, 1954

The Special Marriage Act, 1954 allows two individuals from different religions, castes, or nationalities to solemnize and register their marriage without converting to each other's religion. This Act is applicable throughout India.

Option 1: Solemnization at the Marriage Registrar Office

This is the most common method for registering a marriage under the Special Marriage Act.

• Both parties must file a Notice of Intended Marriage with the Marriage Officer of the district in which at least one party resides.
• The notice is published and kept on record for 30 days (objection period).
• If no objections are raised, the couple can appear before the Registrar with 3 witnesses on the fixed date to solemnize the marriage.
• The marriage is registered and a certificate is issued on the same day.

Option 2: Solemnization at Any Other Venue (Outside Registrar Office)

Under the Special Marriage Act, marriage can also be solemnized at a venue of your choice (home, banquet hall, community center), but prior approval and arrangement is required:

• The couple must file a Notice of Intended Marriage with the Marriage Registrar as usual.
• During the 30-day notice period, an application for solemnization outside the registrar office must be submitted.
• Additional fees may be applicable for conducting the ceremony at an alternate venue.
• The Registrar will visit the venue along with 3 witnesses and solemnize the marriage on the scheduled date.
• A certificate of marriage is then issued post solemnization.

• Documents required: Aadhaar, Passport-size photos, Date of Birth proof, Residence proof, Affidavit of marital status, etc.
• Minimum age: 21 years (Male), 18 years (Female).
• Marriage under this Act does not require religious ceremony.
• If either party is a foreign national, additional documents and embassy No Objection Certificate (NOC) may be needed.
